BY CLICKING THE "I ACCEPT" BUTTON, YOU AGREE TO
THE FOLLOWING TERMS AND CONDITIONS (THE "AGREEMENT") GOVERNING YOUR
USE OF THE ONLINE STARMINDER SM SERVICE (THE
“STARMINDER SERVICE”) OF HELMSMAN MARKETING, LLC, A MASSACHUSETTS LIMITED
LIABILITY COMPANY (“WE”).
The StarMinder Service is available to all
individuals having a valid State Issued driver’s license and an email account. Each
person who would like to participate in the StarMinder Service must register
individually. In order to participate, we need you to register by providing
your first name, last name, address, email address, phone numbers and your
Massachusetts driver’s license number. Please be careful to enter accurate
data. It may take up to thirty days for your registration to take effect;
therefore, you should not expect to receive reminders of any expiration dates
that may fall within the first thirty days after you register.
By registering in the StarMinder Service, you are agreeing
to receive communications from your insurance agent, including email reminder
notices and commercial communications such as periodic newsletters. Although we
may share your name and email address with our corporate affiliates, we will
not sell or rent your name or email address to unrelated third parties. To
opt-out of this program, please send an email to starminderoptout@helmsmark.com or use the unsubscribe feature contained in communications
from us. Please be aware that if you unsubscribe from this service you will not
receive reminders from us for your license renewal, vehicle registration
renewal, or vehicle inspection.
All persons registered under the StarMinder Service are
legally responsible for complying with all applicable legal requirements
related to the renewal of their driver’s licenses and vehicle registrations, as
well as any state-required inspections of their vehicles.
While we will endeavor to provide timely notices to all
registrants under this service, WE MAKE AND YOU RECEIVE NO REPRESENTATIONS
OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED WITH RESPECT TO THE
STARMINDER SERVICE OF ANY OTHER SERVICES. WE SPECIFICALLY DISCLAIM AND EXCLUDE
ANY AND ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY AND ALL WARRANTIES ARISING FROM
COURSE OF PERFORMANCE, COURSE OF DEALING OR TRADE USAGE. WE SHALL NOT
HAVE ANY LIABILITY FOR ANY LOSS OR DAMAGES OF ANY KIND IN THE EVENT THAT ANY
PERSON REGISTERED UNDER THE PROGRAM DOES NOT RECEIVE A TIMELY AND ACCURATE
REMINDER OF ANY APPLICABLE RENEWAL DATE OR VEHICLE INSPECTION DEADLINE, WHETHER
DUE TO A CHANGE TO AN EMAIL ADDRESS, AN ERROR MADE BY YOUR STATE REGISTRY OF
MOTOR VEHICLES OR STATE AGENCY RESPONSIBLE FOR THE REGISTERING AND MAINTAINING
OF VEHICLES, OUR OWN ERRORS OR OMISSIONS, YOUR PROVIDING INACCURATE
INFORMATION, OR ANY OTHER REASON.
We reserve the right to terminate, cancel or change the
StarMinder Service at any time, for any reason and/or without prior notice.
In addition, you consent to your insurance agent possibly
accessing your RMV records and information from the Massachusetts Registry
of Motor Vehicles. Further, you acknowledge that you have read, understand, and
agree to be bound by: these Terms and Conditions;

The content on this website and these Terms and Conditions,
are subject to change or updating by us at any time without prior notice. The
changes may include superseding terms and conditions or specific notices. YOU
SHOULD REVIEW THESE TERMS AND CONDITIONS FROM TIME TO TIME TO BE AWARE OF ANY
CHANGES THAT ARE MADE. YOUR CONTINUING USE OF THE STARMINDER SERVICE
CONSTITUTES YOUR ACCEPTANCE OF ANY CHANGE OR UPDATE, ALL OF WHICH SHALL BECOME

In order to take advantage of the StarMinder Service you may
be asked to select a user name and password. YOU ARE ENTIRELY RESPONSIBLE FOR
MAINTAINING THE SECURITY AND CONFIDENTIALITY OF YOUR USER NAME AND PASSWORD.
You agree to notify us immediately of any unauthorized use of your account or
any other breach of security. We may deny access or block any transaction made
under your password without prior notice if we believe your password is being
used by someone other than you, or if any unauthorized access to your personal
information has occurred or may occur, or for any other reason, but we are
under no obligation to do so.
WE WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGES OF ANY KIND
THAT MAY ARISE AS A RESULT OF SOMEONE ELSE USING YOUR PASSWORD OR ACCOUNT,

insurance provider or broker, accessible through the StarMinder Service. We
make no warranty regarding any goods or services purchased or obtained from
third parties through the StarMinder Service or any transactions with any third
parties.
